This self-drive rental agreement is entered into, on the one hand, by the company CORPORATIVA LAS ANIMAS SL, with Tax ID number B90174194 and registered office at Carretera de Torreblanca – Mairena, km 5, Postal Code 41500, Alcalá de Guadaira, Seville hereinafter referred to as “THE COMPANY”, and, on the other hand, by the individual making the booking hereinafter referred to as “THE HIRER” or “THE CUSTOMER”, who is of legal age and has the legal capacity to enter into a contract.
The purpose of this contract is the daily rental of a motorhome, including the services and coverages detailed in this document and in the specific offer accepted by the Customer.
In order to formalise the rental and drive the vehicle, the Hirer and any additional driver must strictly meet the following requirements at the time of vehicle collection:
Minimum age: Must be at least 25 years old.
Driving licence: Must hold a valid driving licence with a minimum driving experience of 4 years. Said licence must be valid for driving in Spain and/or in the countries through which the vehicle will travel.
Documentation: Must present the original driving licence, a valid National Identity Document, DNI, or passport, and a credit card in the name of the main driver with sufficient available funds for payment of the security deposit.
The minimum rental period is 3, three, days. The contract shall be formalised for the period agreed in the booking, with the corresponding collection and return date and time.
Price: The total rental price shall be the amount stated in the offer accepted by the Customer and shall include the rental days, the included mileage, the contracted insurance policies and the applicable VAT.
Security deposit: At the time of vehicle collection, THE COMPANY shall place a hold or pre-authorisation on the Hirer’s credit card for the amount of €1,500, one thousand five hundred euros, as a guarantee to cover possible damage, excess mileage, cleaning costs, fuel, traffic fines, unpaid amounts or any other breach of the terms of the contract.
This amount shall be refunded or released after the vehicle has been inspected and returned in the same condition in which it was delivered, deducting, where applicable, any costs incurred by the Customer.
The rental price includes an allowance of 200, two hundred, kilometres per full rental day. Unused mileage from one day cannot be accumulated for subsequent days.
Any excess mileage shall be charged upon return of the vehicle according to the rates in force at that time. The price per additional kilometre must be specified, for example: €0.25/km + VAT.
Compulsory insurance: The vehicle shall have compulsory third-party liability insurance, included in the rental price, covering material damage and personal injury that may be caused to third parties, as well as to the occupants of the vehicle, as established by law.
Comprehensive insurance: THE COMPANY offers comprehensive insurance with the coverages detailed in the policy. This insurance includes an excess payable by the Hirer for each claim, the amount of which shall be detailed in the offer and in the rental agreement. This excess may be reduced or eliminated by taking out additional coverage at the time of booking.
Exclusions: The insurance coverage excludes, among others, damage caused by gross negligence, driving under the influence of alcohol or drugs, participation in races or competitions, use of the vehicle off-road, on tracks or unpaved roads, or driving the vehicle by persons not expressly authorised by THE COMPANY.
In accordance with Regulation EU 2016/679 of the European Parliament and of the Council of 27 April 2016, GDPR, and Spanish Organic Law 3/2018 of 5 December on the Protection of Personal Data and Guarantee of Digital Rights, LOPDGDD, we inform you that the personal data you provide will be processed by CORPORATIVA LAS ANIMAS SL, hereinafter referred to as THE COMPANY, with the identification details stated above.
Your personal data will be processed for the following purposes:
To manage your booking, the rental contract and the relationship with the Customer.
To process payments, refund the security deposit and, where applicable, manage claims with the insurance company.
To comply with legal and public safety obligations, such as the communication of traveller data to the Spanish State Security Forces and Corps pursuant to Royal Decree 933/2021.
To send you commercial communications about our products and services, provided that you have given your express consent to do so.
The legal basis for the processing of your data is the performance of the rental contract, compliance with legal obligations and, for the sending of commercial communications, your consent.
Your data may be communicated to the data processors necessary for the provision of the service, such as insurance companies, repair workshops, etc., and to the competent authorities in compliance with our legal obligations.
The data subject may exercise the rights of access, rectification, erasure, objection, restriction of processing and data portability, as well as withdraw consent at any time, by sending a written request to the address of THE COMPANY or to the following email address: info@david-motorhome.com
